What Happens to a Mortgage When the Homeowner Dies in Louisiana?

A homeowner’s death does not erase the mortgage. The lien remains on the Louisiana home, and payments must be addressed while the family decides whether to keep, refinance, or sell the property. Inheriting the house does not automatically mean an heir personally promised to pay the note, but missed payments can still put the home at risk.

Separate the house, the lien, and personal liability

Title to the house and liability on the loan are different matters. The deceased may have been the only borrower, or a surviving spouse or other co-borrower may also have signed the note. The mortgage secures the lender’s rights in the real estate. An heir who receives the house generally takes it subject to that recorded encumbrance, even if the heir has not personally assumed the debt. Review the note, mortgage, payment history, and title before deciding who will pay and how.

Can the lender demand full payment because the owner died?

Federal law limits enforcement of a due-on-sale clause for specified transfers after death, including certain transfers to relatives. The details are in 12 U.S.C. § 1701j-3(d). This protection does not cancel the debt or excuse missed monthly payments. It means a qualifying death-related transfer should not, by itself, trigger acceleration under the due-on-sale clause.

A person who acquires an ownership interest after death may be a “successor in interest” under federal mortgage-servicing rules. The Consumer Financial Protection Bureau’s Regulation X commentary explains that a confirmed successor can receive servicing protections without first assuming personal liability on the mortgage. Servicers may ask for documents establishing the death and transfer of ownership. Families should keep a written record of what they submit and when.

What should happen while the succession is pending?

Someone should monitor statements, payment deadlines, insurance, and property taxes immediately. Do not assume that a mortgage company will pause collection until a Louisiana judgment of possession is signed. If the home will be sold, obtain a payoff statement and coordinate the sale with the succession’s legal authority. If an heir wants to keep it, ask the servicer about successor recognition and available payment or assumption options. If payments are already behind, address that problem promptly.

Reverse mortgages follow different rules. The CFPB explains that a reverse mortgage can become due after the borrower’s death, subject to rules for a co-borrower or eligible nonborrowing spouse. Do not apply ordinary forward-mortgage advice to a reverse mortgage without checking the documents.

Four different conversations with the servicer

Requesting servicing information, becoming a confirmed successor in interest, assuming personal liability on the existing note, and refinancing into a new loan are different steps. Ask the servicer which step it is proposing and what proof it requires. Do not sign an assumption or new loan merely because the family needs statements or payment instructions.
