Elder Law and Incapacity Planning

Elder-law planning helps a person preserve choice while creating practical authority for trusted people to assist with finances, property, health care, and changing care needs. Field Law separates the legal questions from the family pressure, prepares the documents that fit the client's capacity and goals, and explains when a court process or additional planning may be necessary.

Morgan Field speaking with an older adult

Care resources across three parishes

Capital Area Agency on Aging provides separate service listings for West Baton Rouge, Iberville, and Pointe Coupee. Start with the older adult’s parish and ask the provider about eligibility and availability. If relatives coordinate support across parish lines, distinguish the person arranging services from the legally authorized agent and decide how records will be shared.

Field Law is not affiliated with these providers. Services and eligibility are determined by the provider. The legal review should identify the client, the person’s wishes and capacity, and the actual authority needed before family members sign documents or move property.

The decisions this page helps organize

Financial authority

A Louisiana mandate can grant specifically described powers for banking, bills, property, insurance, benefits, taxes, records, and other matters. The agent's powers and safeguards should match the real need.

Health-care decisions

A health-care mandate, living will, HIPAA authorization, and related instructions address different parts of medical decision-making. Copies should be available to the people and providers who may need them.

Capacity, care, and protection

A diagnosis does not by itself answer legal capacity. Planning should occur while the person can understand and choose. When authority is missing or exploitation is suspected, the response may involve protective measures or interdiction after less restrictive options are considered.

A four-step elder law and incapacity planning process

STEP 1

Listen to the older adult's priorities and current concerns.

STEP 2

Separate financial, medical, care, and property decisions.

STEP 3

Choose trustworthy decision-makers and practical safeguards.

STEP 4

Execute, distribute, and review the documents as circumstances change.

Focused experience, practical communication

Port Allen Elder Law Attorney FAQs

When should an older adult sign planning documents?

Ideally before a crisis, while the person can understand the document, select trusted agents, and explain personal priorities. A diagnosis alone does not decide legal capacity.

Does one power of attorney cover every decision?

Not necessarily. Louisiana financial authority and health-care decision-making should be addressed deliberately, and institutions may require particular language or supporting documents.

What if the person can no longer grant authority?

The family may need to consider interdiction or another lawful option. The right response depends on capacity, the needed decision, existing documents, and less restrictive alternatives.
