What Is Succession Litigation in Louisiana, and When Does a Family Need It?

Many successions are routine. Some are not. A succession becomes litigation when there is a real dispute that cannot be resolved through ordinary administration. That may mean a fight over a will, over who the heirs are, over who should administer the estate, or over what happens to a house, business, or account.

Common triggers include will contests, filiation disputes, competing heirship claims, accusations that the executor is not acting fairly, and battles over whether estate property can be sold, occupied, or transferred. These matters often begin as family disagreements and then become formal court disputes once one side realizes that paperwork alone will not solve the problem.

Louisiana procedure treats contested succession matters differently from ordinary ex parte proceedings. Once a real factual dispute exists, affidavits and assumptions are often not enough. The case may require testimony, records, exhibits, and hearings much more like ordinary civil litigation.
