Which Ancillary Procedure Applies?
Possession
The successors may seek possession when no Louisiana administration is needed. The foreign record and Louisiana property must support the requested judgment.
Ancillary Administration
A representative may need Louisiana authority to collect, manage, sell, or defend property. The court can qualify a foreign representative or appoint another qualified person.
Small Succession Affidavit
Some qualifying estates can use an affidavit. The ordinary ancillary value limit remains $125,000. Article 3421 also includes a separate category for deaths at least twenty years before the affidavit, without a property-value limit. Other statutory conditions still apply.
The $200,000 limit effective August 1, 2026 applies to certain Louisiana-domiciled decedents. It did not raise the separate $125,000 ancillary limit in Louisiana Code of Civil Procedure article 3421.

A foreign order may supply important evidence, but Louisiana immovable property usually requires Louisiana succession authority and local recordation.
Where Is the Ancillary Succession Filed?
Venue depends on the Louisiana property and applicable succession rules. Property in East Baton Rouge Parish commonly places the proceeding in the Nineteenth Judicial District Court.
What If No Probate Was Opened in the Home State?
Louisiana may still provide a route, but the Will, domicile, successors, and property determine what proof the court needs. We review those facts before choosing the filing.
