What Out-of-State Families Need to Know About Louisiana Successions

Families are often surprised to learn that handling part of an estate in another state does not always solve the Louisiana side of the problem. If the person who died owned Louisiana property, there may still need to be a Louisiana succession or related proceeding before title can be transferred correctly.

This comes up most often with houses, camps, family land, mineral interests, and other immovable property. Even when a main probate is already open somewhere else, Louisiana may still require its own process to deal with Louisiana assets.

Venue, domicile, and the nature of the property all matter. A family may already be working with a probate lawyer elsewhere and still need separate Louisiana counsel to clear title, probate a will here, or move heirs or legatees into possession of Louisiana property.

Louisiana also uses succession terminology and civil-law concepts that can be unfamiliar to out-of-state families. Assumptions from common-law probate systems often create delay here. That is especially true when the family thinks an out-of-state judgment automatically solves a Louisiana immovable-property problem.

Field Law regularly works with out-of-state clients on Louisiana estate and succession matters. These cases often require coordination with family members, representatives, and professionals in more than one state while still following Louisiana-specific rules.

If your family is handling an estate elsewhere but still has Louisiana property to deal with, Field Law can help you understand what Louisiana requires and what has to happen next.
